Please read these terms carefully before using Amicus. By accessing or using the app, you agree to be bound by these terms. If you do not agree, do not use the service.
Amicus is a document template generation tool. Nothing produced by Amicus constitutes legal advice, and no attorney-client (or legal practitioner–client) relationship is formed between you and Potfiction, Jaco Rossouw, or any person associated with the service.
The outputs of Amicus — including generated text, document drafts, timelines, and any other content — are templates and starting points only. They are not a substitute for advice from a qualified, licensed attorney who understands the specific facts of your situation and the laws applicable in your jurisdiction.
Amicus is not a law firm. Potfiction is not licensed to practise law in any jurisdiction.
To the fullest extent permitted by applicable law, Potfiction and Jaco Rossouw shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, loss of data, loss of goodwill, or any legal, financial, or personal harm — arising out of or in connection with your use of Amicus or your reliance on any content it generates.
Amicus is provided “as is” and “as available,” without warranty of any kind, whether express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted availability.
Where liability cannot be excluded by law, our total aggregate liability to you under or in connection with these Terms, regardless of the form of action, is limited to the amount you have actually paid to us in the twelve (12) months preceding the event giving rise to the claim, or R500, whichever is greater.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, or any liability that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or other applicable law.
All content in Amicus is generated by artificial intelligence (Claude by Anthropic). AI-generated content may be inaccurate, incomplete, outdated, or inappropriate for your specific jurisdiction or circumstances. The AI does not have access to current legislation, case law, or legal databases, and it cannot evaluate the particular facts of your case with the nuance a human attorney can.
You must independently verify all information before relying on it for any purpose.
You are solely responsible for how you use the outputs of Amicus. Before signing any document, filing any paperwork, or taking any legal step based on content generated by Amicus, you must obtain independent advice from a qualified legal professional licensed in your jurisdiction.
You confirm that you are at least 18 years of age and have the legal capacity to enter into a binding contract in your jurisdiction.
You agree not to:
You may sign in to Amicus using Google Sign-In or Sign in with Apple. You are responsible for maintaining the security of the account associated with those credentials.
You may permanently delete your account and all associated data at any time from within the app at /account/delete. Account deletion is immediate and cannot be undone. If you are unable to access the in-app deletion flow, you may request deletion by emailing potfiction@gmail.com.
Our content. All rights, title, and interest in and to the Amicus application — including the source code, user interface, design, branding, the “Amicus” name and logo as used in connection with this service, AI prompts and prompt engineering, document templates, and all other materials created by Potfiction — are owned by Potfiction (Jaco Rossouw) and are protected by South African and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use Amicus for your personal, non-commercial purposes in accordance with these Terms. No other rights are granted, whether by implication, estoppel, or otherwise.
Your content. You retain ownership of the documents, text, and information you upload to or input into Amicus (“Your Content”). By submitting Your Content to the service, you grant Potfiction a limited, non-exclusive, royalty-free licence to store, process, transmit, and display Your Content solely to the extent necessary to provide the service to you — including transmitting Your Content to Anthropic (Claude) for AI processing. This licence terminates when you delete Your Content or your account.
You represent and warrant that you have the right to upload Your Content and that Your Content does not infringe the rights of any third party.
Generated outputs. Subject to your compliance with these Terms, you may use the AI-generated outputs produced from your session for your personal legal matter. Potfiction makes no representation that AI-generated outputs are original, novel, or non-infringing, and you remain solely responsible for verifying their suitability before any use. Generated outputs are not legal advice (see §1).
Restrictions. You may not:
Copyright infringement claims. If you believe content on Amicus infringes your copyright, email potfiction@gmail.com with: a description of the work claimed to be infringed, the location of the allegedly infringing material, your contact details, and a statement made in good faith that the use is unauthorised.
You agree to indemnify, defend, and hold harmless Potfiction, Jaco Rossouw, and any person associated with the service from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:
This obligation survives termination of your account and these Terms.
You may terminate your account at any time as described in §4.
We may suspend or terminate your access to Amicus, with or without notice, if we reasonably believe that you have breached these Terms, that your use of the service poses a security, legal, or reputational risk to us or to other users, or that we are required to do so by law. Where reasonably possible, we will notify you, but we are not obliged to do so where prompt action is warranted.
On termination, your right to use the service ends immediately. Sections relating to intellectual property, no legal advice, no liability, indemnity, and governing law survive termination.
Divorce, family, and related laws vary significantly between countries, provinces, and states. Content generated by Amicus may not reflect the current law in your jurisdiction. Amicus does not represent that any generated content is legally valid, enforceable, or appropriate in any specific jurisdiction.
These Terms are governed by the laws of South Africa. Any disputes arising from use of the service shall be subject to the jurisdiction of the South African courts.
Amicus offers one free session. Continued access requires a once-off payment of R149, processed via PayFast. By completing the payment, you acknowledge that you have read and understood these terms, and that digital access is granted immediately upon payment.
No refunds. Amicus is a digital service for which access is granted and performance commences immediately on payment. By proceeding with payment, you expressly consent to immediate performance of the service and acknowledge that any statutory cooling-off rights under the Electronic Communications and Transactions Act 25 of 2002 that may otherwise apply are waived to the extent permitted by law. The payment is therefore non-refundable once access has been granted.
We may update these Terms from time to time. Where we make material changes — for example, changes affecting your rights, payment terms, or how we handle your data — we will give you reasonable advance notice by email or by posting a prominent notice within the app before the changes take effect. Minor or clarifying changes may be made without notice. The “last updated” date at the top of this page will always reflect when the most recent changes were made. Your continued use of Amicus after a change takes effect constitutes acceptance of the revised Terms.
Severability. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Potfiction regarding Amicus and supersede any prior agreements or understandings.
No waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms to any successor in connection with a sale, merger, or restructuring of Potfiction.
Notices. Any notices to us under these Terms should be sent to potfiction@gmail.com. We may give you notice by email to the address associated with your account or by posting a notice within the app.
